Between The Market And The Firm

The Argument That Stopped Working

Hear me talk about it here

Pitch arguments and practice positioning that win client mandates in one market cycle often lose their effectiveness in the next, without partners realising when or why the shift occurred.

This decay happens because commercial effectiveness relies on offering a departure from what clients regularly receive. However, client expectations are continuously reshaped by the volume of competing proposals they review. A successful positioning approach is quickly adopted across the market, converting a former differentiator into baseline criteria.

The Middle East legal market provides a clear illustration. Demonstrating specialised capability around Saudi Arabian civil law offered a distinct competitive advantage following the December 2023 codification of the Civil Transactions Law, court workflow digitisation, and local data residency rules. Today, multiple firms offer localised statutory analysis and domestic hosting. Jurisdiction-specific capability is no longer a unique selling proposition; it is the baseline requirement for consideration.

A similar pattern affected law firm sector group marketing. Organising practice profiles by industry hubs rather than traditional practice silos was initially an effective departure. Today, nearly every firm presents industry-aligned pages. A generic healthcare page listing dozens of partners now signals to a General Counsel that the firm may lack dedicated sector specialists.

The practical consequence for practice development is that positioning tactics have a shorter useful life than annual plans anticipate. A strategy designed in March can lose its comparative advantage by September simply due to market saturation.

Formats, templates, and broad capability claims are easily replicated across the market. What cannot be replicated is tailored doctrinal analysis applied directly to a target client’s specific business structure.

How to Apply This to Your Practice Development:

Pitching & Client Proposals: Avoid relying on broad industry claims or generic practice credentials. Open pitch conversations with a bespoke doctrinal audit tailored to the prospect’s actual business setup analysing how a specific regulatory threshold, joint-venture structure, or cross-border cap-table arrangement impacts their upcoming transactions. Tailored legal analysis grounded in commercial reality cannot be templated by competing practices.
