Between The Market And The Firm

What Got Cheap, and What Got Expensive

Hear me talk about it here

Generative tools can now produce a competent legal summary of a statute or judgment in seconds, making basic technical drafting universally accessible.

This shift has created two immediate market realities:

  1. The baseline floor has risen: A well-drafted legal summary no longer demonstrates that an attorney invested significant time in an analysis. It demonstrates access to standard software tools.
  2. Evaluation filters have sharpened: Readers evaluate commentary with an implicit question: does this reflect direct practice experience, or was it generated from a primary source text?

As the cost of generating standard legal summaries collapsed, the value of primary institutional experience appreciated. A summary of a new judicial circular offers little value that a client cannot obtain elsewhere. Conversely, insights that cannot be derived from primary legal texts such as practical regulatory enforcement habits, tribunal dynamics, and the real-world application of statutory exceptions have become significantly more valuable.

Furthermore, being cited inside automated search summaries does not translate to direct client instructions. Studies indicate that users click source links in a small fraction of search sessions involving summarized answers. Material can inform an automated output without generating direct inquiries for the author.

Automated tools excel at the baseline layer: organising primary research, compiling case law, and producing initial drafts. Utilizing technology for these operational tasks is necessary for efficiency.

The error lies in relying on automated tools at the value layer. Delivering meaningful commentary requires context and doctrinal judgment. These are inputs that software cannot independently acquire.

How to Apply This to Your Practice Development:

LinkedIn Thought Leadership & Personal Branding: Avoid publishing basic statutory recaps or case summaries that clients can generate instantly with software. Focus your public commentary on deep doctrinal interpretation and enforcement realities: how regulatory authorities exercise statutory discretion, how specific contractual defenses perform in litigation, or how unwritten negotiation boundaries operate in practice. Demonstrating real-world doctrinal judgment builds a professional brand that technology cannot replicate.
